Off-grid living in Illinois: a property guide

Private infrastructure is regulated infrastructure: IDPH and its local partners review wells and sewage systems, while the 2025 building-code baseline does not replace the need to identify the local authority and amendments.

Three files decide the project

IDPH regulates construction, modification and sealing of non-community private wells through agreements with roughly 90 local health departments. Officials review installation plans, issue new-well permits and inspect the work.

Sewage, fuel, livestock and other sources require the applicable IWWCC distances.

Private sewage disposal

“No surface discharge” is still regulated.

IDPH regulates private systems with no surface discharge and systems that discharge treated effluent up to 1,500 gallons per day to the ground surface. Plans for conventional and alternative systems are reviewed before construction; local health agencies may act under ordinance or as department agents.

Who has permit authority? Which soil/site evaluation? Is the design conventional or alternative? Who may install and pump it? What operation duties continue? Is sewer “reasonably available”?

Whole-wastewater rule: a composting or incinerating toilet does not answer how sinks, showers, laundry and kitchen wastewater will be lawfully managed.

Residential construction after January 1, 2025

Baseline does not mean one permit office.

The Capital Development Board says jurisdictions with adopted codes and those without them are both subject to statutory baseline structural requirements. A municipality or county is not forced to adopt a code, but locally adopted codes must meet the state law’s minimum structural standard.

Do not read “no locally adopted building code” as no construction standard. Ask who documents compliance and what other state/local rules apply.

Energy + trades

The Illinois Energy Conservation Code applies statewide; plumbing and other subject-specific laws remain separate.

Classification changes the answer

A home, a rental, and a campground are not the same water system.

Single household

Private-well and private-sewage pathways may apply, subject to parcel and local approval.

Multiple connections

Service count and population can move water into semi-private or public-system regulation.

Home business / guests

Use, users and wastewater character can change design flow and program jurisdiction.

RV or seasonal stays

Local land use, duration and sanitation must be confirmed; a permitted well is not occupancy permission.
